Understanding patent maintenance in Laos

A patent in Laos offers protection for a period of 20 years from the filing date of the application. To maintain this protection period, patent owners have specific obligations, including the payment of annual advance fees and service charges. The payment of these fees is crucial to ensure the continuous validity and enforcement of the patent rights.

Key considerations for patent maintenance in Laos

Annual fees and service charges: Patent owners are required to pay annual advance fees and service charges to maintain the protection period of their patents. The fee for maintaining the protection period for the first four (04) years is included in the fee and service charge paid when filing the patent application. From the fifth (5th) year onward, the owner must pay an official fee and service charge annually to continue the protection period.

Petty patent maintenance: In the case of a petty patent, the protection period is 10 years from the filing date of the application. Similar to patents, the petty patent owner must pay annual advance fees and service charges to maintain the protection period. The fee for maintaining the protection period for the first year is included in the fee and service charge paid when filing the petty patent application. From the second (2nd) year onward, the owner must pay the fee and service charge annually.

Timely payment: To ensure uninterrupted protection, patent or petty patent owners must pay the official fee and service charges for maintaining the advance protection period within six months before the expiry date each year. It is the responsibility of the patent owner to initiate and complete the payment process within this timeframe. The Department of Intellectual Property (DIP) will not issue a notification to remind the owner to pay the fees and charges. Failure to pay within the given time may result in the patent or petty patent being considered expired.

Extension and fines: If the owner fails to pay the official fee and service charges within the specified timeframe, the DIP has the discretion to extend the payment period for an additional six months from the expiry date of the protection period. However, the owner will be required to pay fines for the delay.
